Proposed Alliance Agreement

The following is a draft resulting from matters discussed by Sharpe (9th Fleet) and Frank Ocasio (OC). The intent of this proposal is to make a clear statement of expectations for all fleets, OC, 9th, others, and to set a basic code of conduct for addition of new fleets to the Alliance. The goal of this document is set up interfleet practices and processes that can be acceptable to all fleets and their constituent members, to set up a procedure for improving the terms of this Agreement, and to set consequences for violating fleets and members of those fleets for acting contrary to the goals of the Alliance Agreement.
Please provide feedback in this thread, rather than TS or ingame chats, so that all fleets in the alliance can have full access to all your thoughts and constructive suggestions.
Purpose of the Alliance: Have fun with like minded people.
Articles of Alliance:
1) Cooperation: Fleets will be encouraged to work cooperatively toward common goals. Assistance given will result in assistance returned, in kind. This will include fleet holdings progression.
2) Fair dealings: Honesty and integrity are expected from leaders of each fleet in all interfleet dealings. Failure to provide accurate, true, prompt and timely information to other alliance fleet leaders will be an action sanctionable up to and including by ejection of the individual(s) involved and ejection of the offending fleet.
3) Non-interference: Fleets are separate and independent. No other fleet will be involved in nor permit its members to
participate in interfering in the internal leadership decisions of any member fleet, including access rights, rank criteria, bank access, stores access, among others. Failure to comply will result in permanent ejection of subject individuals from all alliance fleets. Fleets which fail to comply will be permanently ejected from the Alliance.
4) Communication Channels: All communications affecting Alliance Relations will be provided in Writing ONLY. Verbal discussions and agreements will have NO weight unless transcribed and agreed to in writing by participants. In game chats shall be logged and posted to Alliance channel for all members of alliances to review and evaluate.
5) Non disparagement: No alliance fleet member will disparage the leadership of another fleet or spread rumors, incite unrest, or "bitch and moan" about decisions made with which they disagree. Their option is to request transfer, or depart the fleet and the alliance. Violations of this clause will be punishable by up to permanent ejection from all alliance fleets.
6) Violations: Violation allegations will only be considered in writing. Supporting documentation shall be provided (statement of witnesses to verbal transgressions, chat logs of chat channel/tell violations, all emails, forum postings or any other methods of recording the full content, context and sequence of events.
a) for violations by INDIVIDUALS within a fleet, each fleet will take all submitted information and follow its own internal policies and procedures for discipline.
b) for violations of a FLEET, A formal tribunal will be conducted to review and evaluate all such material and to arrive at a consensus action to be taken. No sanctions shall be implemented (fleet ejection from alliance, channel bans (team speak, game, fleet, alliance, other) without the tribunals written authorization.
7) Fleet membership: No alliance member fleet shall accept a former member of an ally fleet as a member without a formal, written transfer between fleets. No member of any alliance fleet is expected to remain in a fleet where they are not happy. However, they must request and receive approval for transfer. They are always free to depart and join any non-alliance member fleet at any time and will be welcomed to return to their former alliance member fleet, as long as doing so will not violate the alliance fleet membership agreement. If a member leaves fleet A, joins a non ally fleet and then subsequently wishes to return to Alliance Fleet B, Fleet B will reject the request until such time that Fleet A provides a written transfer authorization.
Age limits: Ninth has a minimum age. Other fleets may need to have same so issues like profanity can be addressed. [TBD]

10) Ambassadorial Rights: One member of each alliance fleet shall be granted admission to each Alliance fleet to act as an ambassador. The Ambassador role is purely an observational position for compliance. No operational rights (such as promotion, demotion, fleet mail, queuing Holding projects, etc) shall be granted.
11) Admitting new fleets to alliance: Fleet leaders may formally submit a new fleet for Application for admission in such format as approved by the Alliance fleet leaders. Such application will be promptly reviewed and acted upon, and is a requirement for admission. All new fleet members must formally sign the alliance agreement.
12) Secession: Any Fleet is permitted to withdraw from the Alliance at any time, by submitting a written withdrawal notification to the other leaders of Alliance Fleets. Any fleet choosing to do so will not be disparaged or have their reputation impaired for that decision. Any Fleet whose members violate this clause may be removed from the Alliance. Action under this article will not alter in any way the obligations of remaining fleet members to comply with all articles of this Alliance Agreement.
13) Process for Amendment to the Alliance Agreement: This Alliance Agreement can be improved and shall be a document subject to continuing improvement. Petitions for Amendment of this Alliance Agreement may be made by in writing by any Alliance fleet. A Congress of the Fleet leaders will be convened to consider and debate any such amendment within a reasonable period of time (XX days). A formal vote of the Congress shall be conducted, with a 75% approval required. Any such approved amendment will then be placed into a voting status for the members of each alliance fleet to vote on and approve by a 75% vote of the total members of the various alliance fleets (@handles). Approved Amendments shall be added to the Alliance Agreement with full force and effect from the date of approval.
Players Individual Rights:
1) The rights of the Member to enjoy the gaming experience free of Harassment shall not be infringed.
2) No member shall be discriminated against because of his/her/its:
* Sexual Orientation.
* Gender.
* Religion.
* Race.
* Political Views.
* Physical Differences.
3) The rights of the person to express themselves is so granted as far as not to infringe on the rights of others or Violate the Alliance Agreement.
4) The right to debate a topic is granted as far as it does not infringe Upon the rights of others or Violate the Alliance Agreement.
5) The right to public discourse does not include those topics that break The "Law", are taboo by society or Violate the Alliance Agreement.
6) Any speech that may encourage someone to commit acts of violence is prohibited.
7) Any and all members have the right to submit a written petition for changes in the alliance by submitting an amendment to their fleet leadership. (Duplicative with Article 13 above?)
Specific to OC - Suggest moving to OC fleet member rules.
All members have the right to seek justice from the Alliance command if not granted by their fleet or Guild. [This is equivalent to US Military subordinating their military discipline to NATO or the UN. See Article 3 - Non Interference above. If OC chooses to allow this, that is their internal fleet decision, not one to which other allied fleets should be bound.]
Any member can have his argument heard by trial in a public form. [This is a matter for alliance fleets to handle internally based on their individual choices. This may be the choice made by OC and should be in their fleet rules, not alliance rights]
